Terms and Conditions – Closed Beta

Introduction and Acceptance

By accessing, downloading, installing, or using the closed beta of “Under Control: Secrets and Desires” (the “Beta”), the User fully accepts these Terms and Conditions (the “Terms”).

Access to the Beta does not constitute a purchase or product acquisition, but a temporary, limited, personal, non-transferable, and revocable license.

If you do not accept these Terms, the User must immediately cease using the Beta and uninstall it.

Slusiom may modify these Terms at any time. Continued use after publication implies acceptance of the modifications.

1. Definitions

“Slusiom”: Slusiom Development and Design.

“Beta” or “Software”: development version of “Under Control: Secrets and Desires” and its launcher, patches, builds, and associated components.

“User”: person authorized to participate in the Beta.

“Subscription Platforms”: third-party services (e.g., Patreon, SubscribeStar) through which Beta access is managed.

2. Eligibility and Minimum Age

Participation reserved for persons over 18 years of age. Content may be sensitive or for adults.

The User declares that they meet the minimum age and applicable regulations in their jurisdiction.

Slusiom may restrict access by territory, legal requirements, or age rating.

3. Nature of the Beta Program

Limited, personal, and revocable access, primarily for verified subscribers of Subscription Platforms.

The Beta may contain errors, bugs, incomplete or unstable content; progress or data may be lost.

Slusiom may add, remove, or modify functions, content, characters, stories, or mechanics without prior notice.

Public versions may be released with content equal to, different from, or reduced compared to the Beta.

4. Account and Access

Access may be linked to a User account on Subscription Platforms. Such platforms have their own terms separate from Slusiom.

Sharing credentials, reselling keys, lending accounts, or allowing third-party access is prohibited.

Slusiom may require additional verification of identity or subscription ownership.

Access may be limited by device, region, or number of concurrent sessions.

5. Technical Requirements and Updates

Requires permanent Internet connection and accepts continuous automatic updates.

The launcher and game may be modified, patched, or withdrawn without prior notice.

Beta use may consume data and resources; the User assumes such consumption and will configure their firewall/antivirus accordingly.

Slusiom may implement reasonable anti-manipulation or anti-cheat measures.

6. Telemetry, Debugging, and Privacy

Automatic collection: performance, stability, usage metrics, errors, device/system information (e.g., OS version, basic hardware), technical identifiers, and IP addresses.

Optional debugging: User may enable sending extended logs upon request (specific consent).

Purpose: improve stability, performance, security, balance, and gaming experience; analysis and support.

Legal bases: legitimate interest for technical telemetry; consent for optional debugging.

Retention: for the time necessary for indicated purposes and in accordance with legal obligations.

Recipients: Slusiom personnel and providers offering infrastructure/analytics services under contract and confidentiality.

International transfers: if any, will be carried out with adequate guarantees (e.g., standard contractual clauses).

Rights: access, rectification, deletion, opposition, limitation, portability, and others provided by applicable regulations.

Privacy Policy: consult the specific privacy policy for the project available on Slusiom’s website. In case of conflict, the Privacy Policy will prevail.

7. Confidentiality and Restrictions (NDA)

Strictly prohibited:

• Share, leak, publish, retransmit, or distribute any Beta content (includes files, dialogues, assets, data, and mechanics).
• Reverse engineering, decompilation, modification, security bypass, or creation of derivative works.
• Analyze or extract data (datamining) from client, files, or communications.
• Use the Beta for commercial, promotional, or advertising purposes without prior written authorization.

These obligations will survive termination of access.

8. Code of Conduct and Community

Abusive conduct, harassment, hate speech, spam, bug exploitation, cheating, impersonation, or disruption of the community environment will not be tolerated.

“Disruptive behavior” includes, but is not limited to: harassment, discriminatory language, doxxing, threats, malware distribution, service disruption attempts, flooding, or sanction evasion.

Measures: warnings, temporary suspension, permanent expulsion, and banning, depending on severity.

Appeal process: User may request reasoned review through https://slusiom.com/contacts/. Final decision belongs to Slusiom.

9. Intellectual Property and License

All rights to the Software, code, assets, characters, story, and mechanics belong to Slusiom and are protected by Spanish and international legislation.

Slusiom grants a limited, personal, non-exclusive, non-transferable, and revocable license to use the Beta solely for personal testing purposes.

The User acquires no rights of exploitation, copying, distribution, public communication, transformation, or trademarks.

Feedback: User grants Slusiom a worldwide, free, non-exclusive, sublicensable, and perpetual license to use, modify, and exploit any suggestion, idea, bug report, or comment submitted, without obligation of attribution or compensation.

10. Support and Reports

The Beta is offered “as is,” without warranties or support SLA.

Slusiom may request logs or technical information to address incidents.

Bug reports, tests, and suggestions may be prioritized at Slusiom’s discretion.

11. Changes, Patches, and Resets

Slusiom may publish mandatory patches, rebalance systems, remove or add content.

Progress or saved games may be affected or reset during the Beta.

Virtual currencies, rewards, or unlocks in Beta may not transfer to future versions.

12. Termination and Suspension

By User: may cancel at any time by uninstalling the Software and, if applicable, canceling their subscription on the corresponding platform.

By Slusiom: may suspend or terminate access temporarily or permanently for: violation of these Terms, software manipulation, unauthorized distribution, disruptive behavior, or security risks.

Effects: cessation of access and use; confidentiality, intellectual property, liability limitation, and indemnity obligations will survive.

13. Relationship with Subscription Platforms

Beta access may be conditioned on subscription status on third-party platforms (e.g., Patreon/SubscribeStar), governed by their own terms.

Cancellations, charges, and refunds are managed according to those platforms’ rules. Beta access may be revoked upon losing eligible subscriber status.

14. Warranties and Disclaimer

The Beta is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, continuous availability, absence of errors, or non-infringement.

Slusiom does not guarantee that the Beta will be free from interruptions, errors, data loss, vulnerabilities, or incompatibilities.

Notwithstanding the above, Slusiom will make all reasonable and good faith efforts to complete, stabilize, and bring the Software to a final product state in the shortest possible time.

Mandatory consumer rights that cannot be waived by law remain intact.

15. Limitation of Liability

To the maximum extent permitted by law, Slusiom will not be liable for indirect, incidental, special, punitive damages, lost profits, data loss, lost opportunities, business interruption, or device failures arising from use or inability to use the Beta.

Slusiom’s total liability for any claim related to the Beta will not exceed the greater of: (a) €10; and (b) amounts paid directly to Slusiom for Beta access in the preceding 12 months (excluding payments to third-party platforms).

16. Indemnity

User will hold harmless and defend Slusiom against claims, damages, penalties, or costs (including reasonable fees) arising from: (i) improper use of the Beta; (ii) breach of these Terms; (iii) violation of third-party rights; or (iv) unauthorized distribution of content.

17. Export and Sanctions

User declares not to be subject to embargoes, sanctions, or export restrictions that prevent Software use.

Will refrain from using or exporting the Beta in violation of applicable export control regulations.

18. Force Majeure

Slusiom will not be liable for delays or non-compliance due to causes beyond its reasonable control (e.g., provider failures, network outages, attacks, natural disasters, government regulations).

19. Assignment

User may not assign these Terms without Slusiom’s written consent. Slusiom may assign them to affiliates, successors, or assignees in corporate restructuring contexts.

20. Severability and Non-Waiver

If any provision is declared invalid, the remainder will remain in effect.

Failure to exercise a right will not constitute waiver of its future exercise.

21. Entire Agreement

These Terms constitute the complete agreement regarding the Beta and supersede previous communications on its subject.

22. Notifications

Slusiom may communicate changes and notices through the official website, Beta launcher, and/or email associated with the User’s account on the subscription platform or on other official networks or platforms.

23. Language

In case of versions in multiple languages, the Spanish version will prevail. If otherwise indicated in the official document, the designated version will prevail.

24. Applicable Law and Jurisdiction

These Terms will be governed by Spanish legislation.

Jurisdiction: unless mandatory consumer law provides otherwise, parties submit to the Courts and Tribunals of Madrid, Spain. If the User acts as a consumer resident in the EU, they may bring actions in their place of residence.
